The Occupational Safety and Health Administration cannot require em-
ployers to pay for workers' personal protective equipment, the Occupa-
tional Safety and Health Review Commission recently ruled,uphold
ing a 1974 decision.
In the case of Union Tank Car Co.,the commission says OSHA had
not consistently applied a ruling requiring employers to pay for the
PPE that their employees wear on the job. Between 1976 and 1993,
OSHA issued at least five PPE interpretive letters and a revised final
rule in l994, and never stated that employers are required to cover PPE
Costs.
Union Tank Car had required workers at its railroad-car repair frcil-
ity in Cleveland, Texas, to buy their own safety shoes and welding gloves.
Michael Wright, safety and health Director for the United Steel-
workers of America, says the commission decision was "wrong, but
understandable," in light of OSHA's "conflicting interpretations."
