A Study on the Interpretation of Protected Subjects under the Occupational Safety and Health Act 2024.01.05

Abstract
In 2019, the Occupational Safety and Health Act was amended to expand the scope of protection from an employed worker to a labor provider. Although the scope expanded to protect various types of workers who provide labor according to the contract, it is still limited to protecting only a portion of workers with particular types according to the individual provisions of the Act.
This study examines how the scope of subjects to be protected has changed in the process of amending the Occupational Safety and Health Act. In addition, the definition and scope of workers who will be subject to minimum working conditions that must be guaranteed as human beings stipulated in Article 32, Paragraph 3 of the Constitution will be defined.
This study presents the subject that the Occupational Safety and Health Act must protect and the criteria for defining them, which will be used as basic data to set the scope of those who provide labor that the Occupational Safety and Health Act should protect in the future.
